Terms of Use (CGU)

1. Purpose

These Terms of Use ("CGU") govern access to and use of:

  • the executivecyberweek.com website;
  • ECW accounts;
  • the ECW Partner Hub;
  • registration and application forms;
  • networking, connection request and meeting features;
  • Organisation and team spaces;
  • digital content and tools made available as part of Executive Cybersecurity Week.

Any paid service is also subject to the Terms of Sale (CGV) and, as applicable, the Training Terms or the Partnership Agreement / Terms.

2. Initiative and operator

Executive Cybersecurity Week ("ECW") is the event and professional initiative presented on the Website.

Where Cobadisec is designated as the contracting entity or operator of the relevant service, these Terms of Use are entered into with Cobadisec, a company governed by Senegalese law identified in the Legal Notice.

3. Acceptance

The user accepts these Terms of Use when they:

  • create an account;
  • submit a registration / application requiring an account;
  • join an ECW organisation;
  • access the Partner Hub;
  • tick the acceptance box for the Terms of Use;
  • or use an authenticated service after being informed that these terms apply.

These Terms of Use are available on the Website and may be saved or reproduced by the user.

4. Capacity and representation of an organisation

The user warrants that they have the legal capacity required to use the service.

When acting for a company, institution, sponsor or partner, they warrant that they have the necessary authorisation to:

  • communicate the professional data provided;
  • accept these Terms of Use for their own use;
  • carry out the actions for which the organisation has authorised them.

A team member's acceptance of the Terms of Use does not automatically authorise them to sign a contract or financially bind their organisation.

5. ECW account

5.1 Creation

An account may be created using an email address and/or an authorised identity provider.

The user must provide accurate, current and professional information where this is necessary for ECW to operate.

5.2 Security

The user must:

  • keep their credentials confidential;
  • use the security mechanisms provided;
  • promptly report any suspicious access;
  • not share their personal account with a third party.

5.3 Suspension

ECW may temporarily suspend an account where there is a serious risk involving security, fraud, impersonation, scraping, abuse, a breach of these Terms of Use or a need to protect participants. Where reasonably possible, ECW informs the user and allows them to provide explanations.

6. Professional profiles

Users may have a professional profile containing information such as their name, role, organisation, sector, country, biography, photograph, professional email, LinkedIn and visible ECW role.

The user warrants that the content they provide is accurate and professional and that they hold the rights necessary to publish it.

It is prohibited to:

  • impersonate another person;
  • display false qualifications;
  • use a third party's profile without authorisation;
  • publish unlawful, defamatory or confidential information belonging to a third party.

7. ECW statuses and rights

A visible ECW status or role may include: Live, VIP, Speaker, Ambassador, Training Participant, Sponsor Representative or Partner Representative.

These roles may be combined.

Physical access, dinners, private experiences and Partner Hub rights are determined separately. Having a professional title, a role or membership of a sponsoring organisation does not automatically create a right to access another experience.

8. Organisations and teams

8.1 Organisation

A confirmed sponsor or partner may have an Organisation profile and a team space.

8.2 Administrator

Within the limits of their package, the Organization Admin may:

  • invite colleagues;
  • remove a member;
  • manage certain organisation content;
  • view partnership rights;
  • manage certain Partner Hub activities.

The organisation is responsible for the use of its access rights by the members it authorises.

8.3 Seats and event access

A user seat in the organisation / Partner Hub is not a physical pass. Event credentials are allocated separately.

9. ECW Partner Hub

9.1 Purpose

The Partner Hub facilitates professional discovery, shortlists, connections, meetings and relationships between authorised participants.

9.2 Variable rights

Accessible profiles and actions depend on:

  • the participant's status;
  • the organisation's package;
  • rights defined by ECW;
  • the protection of certain profiles;
  • the choices of the person concerned.

9.3 Requests

A request for a connection, meeting or private contact is an invitation, not an obligation. The recipient is free to accept or decline.

9.4 Usage rules

The user must not:

  • scrape or harvest profiles;
  • use unauthorised bots, scripts or automation;
  • circumvent an access limit;
  • export or reconstruct a participant database;
  • resell data;
  • conduct bulk data enrichment through a third party;
  • send spam;
  • harass a participant after a refusal;
  • transfer their access to an unauthorised person;
  • use data for purposes unrelated to a legitimate professional context and the rights granted.

9.5 Controls

ECW may apply technical limits, quotas, anti-abuse controls and security audits to protect the ecosystem.

10. Communication between users

Users are responsible for the content of their exchanges and the compliance of their prospecting activities outside the platform.

The visibility of professional information in the Hub does not make ECW an agent for a message sent by a sponsor and does not exempt the sender from complying with applicable legislation.

11. User content

The user retains the rights to the content they submit, subject to third-party rights.

For the period necessary to provide the service, they grant ECW a non-exclusive licence to host, technically reproduce, display and adapt this content solely to:

  • provide the service;
  • display their profile / Organisation profile;
  • produce ECW materials to which they have consented or which are contractually provided for;
  • ensure security and technical compatibility.

This licence does not allow ECW to freely resell the user's content.

12. ECW intellectual property

Rights to ECW, the Website, interfaces, texts, databases, content, trademarks, logos and distinctive elements belong to their respective holders.

The user receives only a personal or professional right of use limited to the service and the duration of the rights granted.

Any substantial copying, resale, reverse engineering, structured extraction or creation of a competing service using the Partner Hub is prohibited, subject to mandatory rights provided by law.

13. Third-party links and services

ECW may integrate or redirect to third-party services (authentication, payment, LinkedIn, videoconferencing, etc.). Their own terms apply to the relationship between the user and the third party where relevant.

14. Service availability

ECW strives to ensure reasonable availability but does not guarantee uninterrupted operation.

Interruptions may result from maintenance, updates, incidents, attacks, supplier failures or force majeure.

ECW may modify a feature where necessary for security, compliance, service quality or product development, without arbitrarily removing a contractually paid benefit without an appropriate measure.

15. Security reporting

Vulnerabilities must be reported in accordance with /responsible-disclosure.

Any attempt at unauthorised access, exfiltration, denial of service or social engineering is prohibited.

16. Personal data

Data processing is described in the Privacy Policy and the Cookie Policy.

Using the Partner Hub also requires respect for the confidentiality of accessible data.

17. Sanctions

In the event of a serious or repeated breach, ECW may, in particular:

  • warn the user;
  • limit a feature;
  • suspend the account;
  • withdraw access;
  • exclude a participant from an experience;
  • terminate the service in accordance with contractual terms;
  • preserve necessary evidence;
  • take any action required to protect its rights or those of third parties.

The measure taken must be proportionate to the seriousness of the situation where reasonably possible.

18. Liability

Each user remains responsible for:

  • their professional decisions;
  • the information they publish;
  • relationships entered into with other users;
  • verifying a counterparty before entering into a contract;
  • compliance with the laws applicable to their communications.

ECW provides a connection and event environment; ECW is not a party to business contracts entered into between participants, unless otherwise agreed in writing.

No networking feature constitutes a guarantee of a meeting, sale, investment, partnership, recruitment or commercial outcome.

19. Electronic evidence

Logs, confirmations, timestamps, confirmation emails, versions of accepted terms, electronic signatures and technical records may be used as evidence within the limits provided by law.

20. Changes to the Terms of Use

The Terms of Use may be updated, in particular to reflect changes to the service or regulations.

Where a change substantially affects a service already subscribed to, ECW informs the user by an appropriate means. Rights acquired under a signed contract remain governed by the order of precedence set out in the contractual documents.

21. Governing law and dispute resolution

Where Cobadisec is the relevant operator, the Terms of Use are governed by Senegalese law, subject to applicable mandatory rules.

Before initiating proceedings, the parties endeavour to resolve the dispute amicably within a reasonable period following a sufficiently detailed written notice.

Where the dispute is commercial and the parties agree, they may use mediation in accordance with the principles of the OHADA Uniform Act on Mediation.

Failing an amicable agreement, the competent courts of Dakar may be seized where this jurisdiction clause is legally valid. Mandatory consumer rights are not excluded.

22. Order of precedence

In the event of a conflict:

  1. the specific signed contract / agreement prevails;
  2. the specific Terms (Training / Partnership / Participation) prevail for their subject matter;
  3. the Terms of Sale prevail for paid commercial matters;
  4. these Terms of Use apply to the general operation of the service.
